ABSTRACT
Subsidies have been an issue in international trade law for more than 100 years. The General Agreement on Tariffs and Trade (GATT) took some initial steps in the area. The Uruguay Round added considerable precision and effective (at least so far) discipline on export subsidies and (possibly) import substitution subsidies. The WTO Agreement on Subsidies and Countervailing Measures (Subsidies Agreement) was a landmark achievement, notably by including an agreed definition of subsidy. Subsequent Panel and Appellate Body jurisprudence has resulted in important interpretations of key articles such as Articles 1, 2, 3 and 14. The Doha Round involved several suggestions for modifications to the Subsidies Agreement, along with highly creative and ambitious consideration of subsidies in the context of the fisheries negotiations (and also the earlier, uncompleted negotiations on subsidies in services). In the meantime, events such as the global financial crisis and the challenges posed by climate change and global supply chains have added a new political and economic context for considering the future policies to be applied to subsidies. The session will discuss this evolution and speculate on future directions of subsidies jurisprudence and negotiations.
The speakers will discuss their experience with GATT jurisprudence and policies on subsidies, the formation of the WTO rules in the Uruguay Round and their implementation in national practice and through the WTO dispute settlement system, as well as reflect on the future of WTO subsidies rules.
