DS367: Australia — Measures Affecting the Importation of Apples from New Zealand

At the start of the meeting, the Chairman informed the DSB that Australia had notified the DSB of its decision to appeal the panel report and that the report could not be considered for adoption by the DSB until after the completion of the appeal. The item was therefore removed from the agenda.

DS383: United States — Anti-Dumping Measures on Polyethylene Retail Carrier Bags from Thailand

This item was on the agenda at the request of the US. According to an agreement between Thailand and the US (WT/DS383/6), the reasonable period of time for implementation in this case expired on 18 August 2010. At today’s meeting, the US informed the DSB that it had implemented the rulings. The US Department of Commerce's new determination came into effect on 28 July 2010. Thailand thanked the US for its continued cooperation, especially its timely determination. Thailand said that it would continue to monitor the implementation of this determination.

Under “Other business”, the Chairman made a statement regarding the amendments to the Working Procedures for Appellate Review. He said that after having received and carefully considered comments made by members during the regular DSB meeting of 18 May 2010 as well as the written comments received by the 26 May 2010 deadline, the Appellate Body had, on 27 July 2010, circulated a communication containing the final amendments to its Working Procedures (WT/AB/WP/W/11).

Subsequently, the revised and consolidated version of the Working Procedures for Appellate Review was circulated on 16 August 2010 (WT/AB/WP/6). The Chairman drew members’ attention to the fact that the modified rules would apply to appeals initiated on or after 15 September 2010. Any appeals initiated before 15 September 2010 remained subject to the previous version of the Working Procedures (WT/AB/WP/5).
